This privacy policy (“Policy”) describes how OnYourMarketing, LLC (DBA HVACMarketing.com, DBA Fuseomatic.com) and its related companies (“Company”) collect, use and share personal information of consumer users of this and other related websites, (the “Sites”), including but not limited to www.hvacmarketing.com, www.hvaccustomersnow.com, www.onyourmarketing.com, www.fuseomatic.com, www.bridgebuddy.io, www.fortapay.com and www.affiliatedash.com. This Policy also applies to any of our other websites that post this Policy. This Policy does not apply to websites that post different statements.
1. PERSONAL INFORMATION WE COLLECT

When you visit our Site(s), we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site(s), we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site(s), and information about how you interact with the Site(s). When we talk about “Personal Information” in this Privacy Policy, we are talking both about Device Information and Contact Information.
2. WHAT WE DO WITH YOUR PERSONAL INFORMATION

We use the Contact Information that we collect generally to fulfill any orders placed through the Site(s) (including processing your payment information, arranging for shipping if applicable, and providing you with invoices and/or order confirmations). 3. SHARING YOUR PERSONAL INFORMATION

We share your Personal Information with third parties to help us use your Personal Information, as described above. For example, we use Infusionsoft for our Customer Relationship Management software. Finally, we may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.

4. CONSENT

When you provide us with Personal Information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we receive your consent to our collecting it and using it for that specific reason only. If we ask for your Personal Information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.

As described above, we use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. Additionally, if you are a European resident we note that we are processing your information in order to fulfill contracts we might have with you, for example, if you make an order through the Site(s), or otherwise to pursue our legitimate business interests listed above. Additionally, please note that your information will be transferred outside of Europe, including the United States.

8. DATA RETENTION

When you place an order through the Site(s), we will maintain your Order Information for our records.

9. DISCLOSURE

We may disclose your Personal Information if we are required by law to do so or if you violate our Terms of Service.

10. PAYMENT

If you choose a direct payment gateway to complete your purchase, then Infusionsoft stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS).

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Expr

ess and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

11. THIRD-PARTY SERVICES

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.

For these providers, we recommend that you read their privacy policies so you can understand the manner in which your Personal Information will be handled by these providers.

In particular, remember that certain providers may be located in or have facilities that are located in a different jurisdiction than either you or us. As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your Personal Information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.

Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our Site’s Terms of Service.

When you click on links on our Site(s), they may direct you away from our Site(s). We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements.

13. SECURITY

To protect your Personal Information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.

If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.
